GNR40 HERITAGE TERMS & CONDITIONS FOR CONTENT SUBMISSIONS
- 1. The GNR40 Heritage project is owned and organised by Great North Run Culture, Nova International Ltd and any of its subsidiaries, referred to as “We” or “Us”.
- 2. Any content, media, information, comments and messages submitted will be known as “User Content”. You retain ownership of any User Content you submit.
- 3. By submitting any User Content:
3.1 You grant Us a perpetual, royalty free, non-exclusive, and irrevocable right and licence to use, reproduce, edit, adapt, modify, combine with other materials, prepare derivative works based upon, distribute, publicly perform and display such User Content, in whole or in part, in any form, media or technology known or hereafter developed;
3.2 You are granting permission to Us, in relation to the GNR40 Heritage project, to use the name, likeness, voice, photograph, image and personality of any person depicted or identified in the User Content, in connection with the User Content and in relation to the exercise of the rights granted in this Section;
3.3 You waive all moral rights or similar rights now existing or created in the future in any part of the world in respect of the User Content, including any right to credit or attribution in relation to use of the content; and
3.4 You acknowledge and agree that You will not be entitled to any compensation or payment for Your User Content submission, including any cost which you have incurred in creating or uploading it, regardless of whether it is selected for use, and regardless of where it may be used, or whether We may receive value from its use.
3.5 You confirm that You are aged 18 or over, or if You are aged between 13 and 18, Your parent or legal guardian has accepted these addition provisions on Your behalf.
CONTENT STANDARDS: USER CONTENT and WARRANTIES
4 The following “Content Standards” must be followed at all times in relation to all User Content submitted. You are solely responsible for any User Content You submit. You warrant or promise that:
4.1 User Content will NOT contain material, or depict or promote activity, that is sexually explicit, obscene, pornographic, violent, (including for example, the sale of weapons, cruelty or abuse), discriminatory (e.g., based on race, sex, religion, physical disability, sexual orientation or age), illegal (e.g. underage drinking, substance abuse or computer hacking), offensive, threatening, profane, or harassing;
4.2 User Content will NOT include any copyrighted material that has not been adequately cleared prior to submission, including, but not limited to, music, film, books, television programming, artwork, sculpture, photographs, characters, plot elements, descriptions or any other material protected by copyright or other intellectual property law;
4.3 User Content must NOT include any trademarks, logos, insignia, or location signage, or identify or promote the goods or services of any person or entity, except in response to a specific call therefore;
4.4 You must exclusively own, or have sufficient rights to, all User Content submitted (and all material incorporated in the content) and have sufficient rights to submit the content and authorise the uses, and grant the rights, set forth herein;
4.5 User Content has NOT been captured at an event or in any circumstances at which the taking of audio-visual, audio only or photograph recordings is prohibited;
4.6 User Content will NOT violate the privacy rights or rights of publicity of any person or impersonate or otherwise misrepresent affiliation, association, or connection with, any person or entity;
4.7 User Content will NOT contain any confidential information, be in breach of confidence, be in breach of contract or in contempt of court;
4.8 User Content must NOT be libellous or otherwise defamatory. If User Content includes any statements that are offered as facts, you must believe those statements to be true and have a reasonable basis for such belief;
4.9 User Content must NOT include personal information or data about a person under the age of thirteen (13) years;
4.10 You must have sufficient authority, with respect to all individuals depicted or identified in the User Content, to submit the content and authorise the uses, and grant the rights, set forth herein;
4.11 if User Content depicts or identifies any minors (being anyone under the age of 18), you represent and warrant that you are the parent or legal guardian of such individuals or have permission from such parent or guardian;
4.12 User Content must comply with all applicable laws and with any other requirements posted by Us in relation to Projects for which the User Content is submitted;
4.13 User Content must NOT contain any information, software or other material of a commercial nature; and
4.14 User Content must NOT contain any virus, Trojan horse, worm, time bomb, cancelbot or other similar harmful programming routine.
5. We are under no obligation to use any content submitted by You and we retain absolute discretion in relation to all content submitted. In any event we reserve the right to determine whether the content is compliant with the Content Standards and may remove, delete or modify it if the content is in breach of the Content Standards, or for any other reason at Our absolute discretion.
